TERMS AND CONDITIONS

1. Introduction

Welcome to the Hestya interior design app ("App"). These Terms and Conditions ("Terms") govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not use the App for any other purpose, including but not limited to any commercial purpose or for any use that is illegal or unauthorized.

3. User Content

The App may allow you to upload, post, or submit content, including but not limited to images, designs, videos or other materials ("User Content"). By uploading, posting, or submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media now known or hereafter developed.

You represent and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content in the manner contemplated by these Terms; and (ii) your User Content does not violate any intellectual property rights or other rights of any third party.

We reserve the right to remove or modify any User Content that we believe, in our sole discretion, violates these Terms or any applicable law or regulation.

4. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, texts, displays, images, videos, and audios, and the designs, selections, and arrangements thereof), are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may use the App for your personal, non-commercial use only. You may not use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App. You may not attempt to gain unauthorized access to any part of the App, or any systems or networks connected to the App.

5. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information in connection with the App.

6. Updates

We may update the App from time to time to add new features, improve performance, and enhance security. These updates may be provided automatically or manually, depending on your device settings. By using the App, you agree to receive such updates and to permit us to deliver them to you. We reserve the right to modify or discontinue the App, or any portion thereof, with or without notice to you. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, nor do we make any warranty as to the accuracy, completeness, reliability, or currency of any information provided through the App.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App or these Terms, even if we have been advised of the possibility of such damages. In no event shall our total liability to you exceed the amount paid by you, if any, for accessing the App.

9. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your breach of these Terms.

10. Termination

We may terminate your access to the App at any time, with or without cause or notice, in our sole discretion.

11. Governing Law and Jurisdiction

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the state of New Hampshire, without giving effect to any choice or conflict of law provision or rule that would require or permit the application of the laws of any other jurisdiction. Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the federal or state courts located in the state of New Hampshire. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Changes to Terms and Conditions

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

13. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions or agreements that may be posted on the App, constitute the entire agreement between you and us regarding your use of the App.
